Discrimination and Harassment

Discrimination and harassment are against the law and are prohibited by the Code of Professional Conduct.

What is discrimination?

Discrimination involves treating someone differently, to their disadvantage and without reasonable cause, on the basis of a characteristic such as their actual or perceived race, colour, ancestry, nationality or ethnic background or origin, political belief, religion or creed, marital or family status, source of income, physical or mental disability, physical characteristics, age, sex including pregnancy, marital or family status, sexual orientation or gender identity. It is an act or omission which effectively denies an individual or group opportunities or benefits available to others because of a distinction relating to their personal attributes.

What is harassment?

Harassment is abusive and unwelcome behaviour or comments that degrade, demean, humiliate or embarrass a person. It is a form of discrimination if it is based on an individual’s actual or perceived race, colour, ancestry, nationality or ethnic background or origin, political belief, religion or creed, marital or family status, source of income, physical or mental disability, physical characteristics, age, sex including pregnancy, marital or family status, sexual orientation or gender identity.

Sexual harassment is a form of discrimination and includes objectionable and unwelcome sexual solicitations or advances, a sexual solicitation or advance made by a person in a position of authority or a reprisal or threat of reprisal for rejecting a sexual advance.

Role of the Equity Officer

The Law Society of Manitoba’s Equity Officer is available to provide confidential information, advice and assistance to Manitoba lawyers, articling students, legal support staff and clients of lawyers in dealing with issues of discrimination and harassment. The Equity Officer also seeks to prevent discrimination and harassment through a variety of educational and policy initiatives aimed at promoting equity, diversity and inclusivity in the legal profession.

The Equity Officer is responsible for coordinating the Law Society of Manitoba’s response to the Truth and Reconciliation Commission’s Calls to Action.

How can the Equity Officer help?

The Equity Officer can:

  • Offer confidential and neutral information, advice and assistance to individuals regarding particular problems and provide information on the options available to address issues; 
  • Attempt to informally resolve or mediate discrimination or harassment disputes;
  • Consult with any private or public law office wanting to address an issue, raise staff awareness about the importance of a respectful workplace environment or deliver educational seminars;
  • Provide model policies on maternity and parental leave, alternative work schedules, respectful workplaces, accommodation, equity and diversity and best practices for employment interviews; and
  • Identify resources, such as counselling and other support programs

What you should know

  • A call to the Equity Officer is not a complaint to the Law Society. All communications with the Equity Officer will be strictly confidential*, unless otherwise agreed. The only reporting provided to the Law Society is of a general statistical nature.
  • The Equity Officer does not provide legal advice.
  • The Equity Officer’s services are offered free of charge
