The forms under the Real Estate Brokers Act
The forms under the Real Estate Brokers Manitoba Regulation 56/88R are amended from time to time. The last amendment was to Form I of Schedule A (Residential Form of Offer to Purchase) and came into force on August 1, 2011. At that time paragraphs 7 and 8 of the Offer to purchase were amended by:
- Requiring the provision by the Seller of a property Disclosure Form (in the prescribed form); and
- Including as a condition that the Buyer obtain a satisfactory inspection of the property.
Each of these provisions could be deleted at the option of the Buyer.
The amending Regulation also provided for a review by The Manitoba Securities Commission of all forms under the Act every five years. The Commission completed its review of the forms in 2016, however, prior to making a determination as to recommending additional amendments, a decision has been made to consult with the legal and real estate professions.
The Commission is seeking comment from the professions. This review is intended to include all existing forms. The Commission will be accepting written submissions on whether any of the forms under the Act should be amended, replaced or repealed until and including March 31, 2017.
